3. Terms of Sale (Conditions Générales de Vente - CGV)

Article 1 – Scope and Object

These Terms of Sale govern all contractual relations between Poème Minéral ("the Seller") and any individual or legal entity ("the Customer") making a purchase through the website poememineral.com.

Placing an order on this website implies full and unreserved acceptance of these Terms of Sale.

Article 2 – Products and Pricing

  • Products: Products displayed on the website are subject to availability. Descriptions and images are provided as accurately as possible.

  • Pricing: Prices are indicated in Euros (€) tax included, as VAT is not applicable pursuant to Article 293 B of the French General Tax Code (CGI). Shipping fees are calculated and displayed separately during the checkout process before payment confirmation.

  • The Seller reserves the right to modify prices at any time, but products will be billed based on the rates in effect at the time the order is placed.

Article 3 – Order & Payment

  • An order is considered final once payment has been authorized and confirmed.

  • Accepted Payment Methods: Payments are processed securely via Credit Card (Visa, Mastercard, American Express), Apple Pay, or PayPal through Shopify Payments.

  • Payments are encrypted and secured using SSL protocols.

Article 4 – Delivery

  • Products are shipped to the delivery address provided by the Customer during the ordering process.

  • Estimated delivery times are outlined in our Shipping Policy (typically 7–12 business days).

  • Ownership and risk of loss pass to the Customer upon physical delivery of the goods to the address provided.

Article 5 – Right of Withdrawal (14-Day EU Return Policy)

In accordance with European Union consumer legislation (Article L. 221-18 of the French Consumer Code):

  1. Withdrawal Period: The Customer has 14 days from the date of receipt of the products to exercise their right of withdrawal without giving any reason or paying penalties.

  2. Notification: To exercise this right, the Customer must notify the Seller of their decision by emailing poeme.mineral@gmail.com.

  3. Return Conditions: Items must be returned unused, undamaged, and in their original packaging. Return shipping costs are the responsibility of the Customer unless the product delivered was incorrect or defective upon arrival.

  4. Refunds: Refunds will be processed within 14 days of receiving the returned package using the same payment method used for the original transaction.

Exceptions: Perishable, customized/personalized items, or sealed goods unsealed for hygiene reasons are exempt from the right of withdrawal.

Article 6 – Legal Guarantees

Customers benefit from statutory legal guarantees under French and EU law:

  • Legal Guarantee of Conformity (Articles L. 217-3 et seq. of the French Consumer Code): Protects against defects existing prior to delivery within 2 years of purchase.

  • Guarantee against Hidden Defects (Articles 1641 et seq. of the French Civil Code): Allows for a refund or price reduction if the product suffers from a hidden manufacturing defect.

Article 7 – Intellectual Property

All content on poememineral.com (text, graphics, logos, images, UI design) is the exclusive property of Poème Minéral. Any unauthorized reproduction, extraction, or distribution is strictly prohibited.

Article 8 – Applicable Law & Dispute Resolution

  • Governing Law: These Terms of Sale and any disputes arising from them are governed by and construed in accordance with French Law.

  • Amicable Settlement: In case of a dispute, the Customer should first contact [Your Customer Service Email] to seek an amicable solution.

  • Online Dispute Resolution (ODR): European consumers can also submit complaints to the EU Commission’s ODR platform at ec.europa.eu/consumers/odr.
